For and in consideration of permitting __________________________________ (the “Competitor” or “Participant”) to join Trench Tech, Inc. Purebred Gym or its Trench Warz, Rites of Passage and The Art of War Grappling promotions, the Competitor/Participant hereby assumes all risks of such activity and voluntarily releases, discharges, waives and relinquishes any and all claims or causes of action for personal injury, property damage or wrongful death occurring to himself/herself arising as a result of engaging or receiving instruction in the Fight match and activities or any activities incidental thereto wherever or however the same may occur and for whatever period said activities or instruction may continue; and for himself /herself, his/her heirs, executors, administrators and assigns does hereby agree that under no circumstances will he/she or his/her heirs, executors, administrators, and assigns prosecute or present any claim for personal injury, property damage or wrongful death against the Gym or any of its officers, agents, employees, servants, and landlord for any of said causes of action, whether the same shall arise by the negligence of any of said persons or otherwise. IT IS THE INTENTION OF THE PARTICIPANT BY THIS INSTRUMENT TO EXEMPT AND RELIEVE THE PROMOTER, TRENCH TECH INC. PUREBRED SAIPAN MMA, ITS LANDLORD, & ALL SPONSORS , THEIR OFFICERS, DIRECTORS, & PERSONNEL FROM LIABILITY AND HOLD ALL HARMLESS AND INDEMNIFY THEM FROM ANY AND ALL CLAIMS FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE AND OR ACCIDENTAL.
The Competitor/Participant, for himself/herself, his/her heirs, executor, administrators or assigns agrees that in the event any claim for personal injury, property damage, or wrongful death shall be prosecuted against the Gym and Landlord arising out of his/her participation in the Gym or Trench Warz events, he/she shall indemnify and save harmless the Gym from any and all claims or causes of action by whomever for personal injuries, property damage or wrongful death.
The Competitor/Participant agrees that the Gym & Landlord & all Sponsors shall not be responsible or liable to him/her or his/her guests for articles lost or stolen in the Gym. In addition, the Gym & Landlord shall not be liable for loss or damage to any other property of him/her or his/her guest(s), including his/her automobile(s) and contents. It is agreed that any damages to the Gym facilities or property or to the property of the Fighter/Participant and their guest(s) by any other Member or his/her guest(s) is the sole responsibility of the Fighter/Participant.
The Competitor/Participant acknowledges that he/she has read the foregoing three paragraphs, and has been fully and completely advised of the potential dangers incidental to engaging in the Gym activities or Trench Warz and is fully aware of the legal consequences of signing this instrument.
PARENTS OR LEGAL GUARDIANS OF MINORS:
I/We, the undersigned parent(s) or legal guardian(s) of __________________________________, for and in consideration of our child’s participation in the Gym and Trench Warz activities available and offered in the Gym, state that we have read the above waiver, release, and indemnification and we agree that the terms and conditions of such waiver, release and indemnification shall apply to and be binding upon us and our minor child insofar as it pertains to his/her participation in the Gym activities and to any injury or damage our minor child may sustain or cause as a result of such participation. ________Initial
